1. We do NOT need any documents from you.
2. Select a Delaware LLC name.
3. Conduct a Delaware LLC name search. We are happy to help you check a corporate name for availability.
4. LLC Formation Filing: We'll prepare the necessary forms and verified them for accuracy. We'll then submit the certificate of formation to the Delaware Secretary of State. It usually takes about 2-3 days for us to receive a filed and stamped copy back from the State.
5. Federal Employer Identification Number: Next, we'll apply for a Federal Employer Identification Number (EIN) for you. You'll need this number to open a bank account or hire employees.
6. Operating Agreement: We'll supply you with an Operating Agreement template. You'll need this document to setup the ownership of your LLC and any other special requirements you want to make a permanent record of your LLC.
7. LLC Members: Delaware does not require that a member's name is on the certificate of formation. In practice, most of our clients do not include any names on the certificate and that is perfectly legal. However, you can have your name or other members' names listed if that is what you wish.
